General Use of Website & Account

General Intellectual Property

Ownership: Content on this website (text, graphics, logos, software, etc.) is owned by Durbhasi Gurukulam or its licensors and protected by IP laws. This does not cover specific deliverables from services unless stated.

Website License: We grant a limited, non-exclusive, non-transferable license for personal, non-commercial use of the website itself. All other rights reserved.

Service-Specific IP: Intellectual property rights concerning materials, software, reports, or other deliverables generated through specific Services (IT, Training, Courses, etc.) are detailed in the respective Service sections below or in separate agreements.

User Content (General)

If you post content on our platforms (forums, portals), you are responsible for its legality and appropriateness. By posting, you grant us a broad license to use, modify, and distribute that content in connection with the Services. We may monitor but aren't obligated to remove content violating these terms.

IT Services Terms

Scope & Agreement: Specific services (support, development, consulting) will be defined in a separate Statement of Work (SOW) or Service Agreement, which forms part of these Terms.

Client Responsibilities: You agree to provide necessary access, information, and cooperation required for us to perform the IT services effectively.

Service Levels (SLAs): Response times, resolution targets, and availability guarantees, if applicable, will be detailed in a separate Service Level Agreement (SLA) document.

Fees & Payment: Fees (project-based, retainer, hourly) and payment schedules will be specified in the SOW or Agreement. Invoices are due upon receipt unless otherwise stated. Applicable taxes will be added.

Term & Termination: Service terms and conditions for termination (notice periods, causes) will be outlined in the SOW or Agreement.

Confidentiality: Both parties agree to maintain the confidentiality of sensitive information shared during the service engagement.

Intellectual Property: Unless otherwise specified in the SOW, pre-existing IP remains with the original owner. Ownership of custom code or deliverables developed during the engagement will be defined in the SOW. We retain rights to our tools and methodologies.

Refund Policy (Example): Fees paid for IT services rendered (hours worked, milestones completed) are generally non-refundable. Retainer fees are non-refundable for the period they cover. Specific refund conditions, if any, will be in the SOW or Agreement.

Disclaimer: While we strive for excellence, we do not guarantee that all technical issues can be resolved or that services will be uninterrupted or error-free.

Cybersecurity Services Terms

Scope & Agreement: Services (audits, penetration testing, monitoring, consulting) will be detailed in a Service Agreement or SOW.

Client Cooperation: Accurate information and necessary system/network access are required for effective service delivery. You represent you have authority to grant such access.

Limitations: Cybersecurity services aim to identify and mitigate risks based on current knowledge and tools. We cannot guarantee 100% protection against all threats or discovery of all vulnerabilities.

Incident Response: If included, the process and scope for responding to security incidents will be defined in the Agreement.

Fees & Payment: Fees and payment terms are outlined in the Agreement. Services may be suspended for non-payment.

Confidentiality: Due to the sensitive nature, strict confidentiality of client systems, data, and findings is paramount and mutually agreed upon.

Data Handling: We will handle client data accessed during services according to agreed protocols and applicable data protection laws.

Refund Policy (Example): Fees for completed assessments, consulting hours, or commenced retainer periods are non-refundable. Project-based refunds, if any, follow the terms in the Service Agreement.

Disclaimer: Our findings and recommendations are based on the information and access provided at the time of service. The threat landscape evolves continuously.

Certification Program Terms

Eligibility & Enrollment: Specific prerequisites may apply. Enrollment requires accurate information and acceptance of these terms.

Fees & Payment: Program and exam fees must be paid as specified during enrollment. Fees are subject to change.

Exam Policies: Rules regarding scheduling, identification, conduct during exams, retake policies, and proctoring (if applicable) must be adhered to. Violations may lead to disqualification.

Certificate Issuance & Validity: Certificates are issued upon successful completion of all requirements. They are valid for a specified period and may require renewal or continuing education.

Use of Credentials: Certified individuals are granted a limited license to use certification logos/titles as per our guidelines. Misuse may result in revocation.

Revocation: Certification may be revoked for exam misconduct, violation of ethics codes, or failure to meet renewal requirements.

Refund Policy (Example): Certification enrollment fees and exam fees are typically non-refundable once paid or after a short initial period (e.g., 48 hours). Check the specific policy at the time of enrollment.

Corporate Training Terms

Scope & Objectives: Training content, duration, and learning objectives will be mutually agreed upon in a Training Proposal or Agreement.

Scheduling & Logistics: Responsibilities for scheduling, venue (if physical), participant communication, and technical setup (if virtual) will be defined in the Agreement.

Fees & Payment: Training fees (e.g., per participant, per day, fixed project) and payment terms are specified in the Agreement. Travel and material costs may be additional.

Cancellation & Rescheduling: Policies regarding cancellation or rescheduling by either party, including applicable fees or notice periods, will be outlined in the Agreement.

Intellectual Property: Training materials (slides, handouts, exercises) are our intellectual property. Client/participants receive a license for internal use only; reproduction or external distribution is prohibited without consent.

Confidentiality: We will treat client business information shared during needs analysis or training as confidential.

Refund Policy (Example): Refund eligibility upon cancellation depends on the notice provided, as detailed in the Training Agreement. For example, 100% refund if cancelled >30 days prior, 50% if 15-30 days, no refund if <15 days. No refunds for non-attendance.

EdTech (Online Courses) Terms

Enrollment & Access: Upon payment, you receive access to the specified course(s). Access duration (e.g., lifetime, 1 year) is stated on the course page.

Fees & Payment: Course fees must be paid in full at the time of enrollment unless a payment plan is offered and agreed upon.

License & Use: You are granted a limited, non-exclusive, non-transferable license to access and view course materials for personal, non-commercial educational purposes only.

Prohibited Conduct: Sharing account login, downloading (unless explicitly permitted), distributing, or reselling course content is strictly prohibited.

Course Updates: We may update course content periodically; access to updates depends on the specific course access terms.

Certificates of Completion: Some courses may offer a certificate upon successful completion; this does not typically confer professional accreditation unless explicitly stated.

Refund Policy (Example): Refunds are available within [e.g., 7] days of purchase IF less than [e.g., 25]% of the course content has been accessed/viewed. Requests must be made via [Specify Method, e.g., email to support@durbhasigurukulam.com]. Subscription refunds follow different terms specified at signup.

Internship Program Terms

Eligibility & Application: Applicants must meet specified criteria (e.g., student status, field of study). Selection is based on our internal review process.

Program Details: Duration, start/end dates, expected hours, location (remote/physical), and learning objectives will be outlined in the Internship Offer Letter or Agreement.

Supervision & Tasks: Interns will be assigned a supervisor and tasks relevant to their learning objectives and our business needs.

Stipend/Compensation: Any stipend or expense reimbursement will be clearly stated in the Offer Letter. If unpaid, this will also be stated.

Code of Conduct & Policies: Interns must adhere to our company policies, including code of conduct, IT usage, and safety rules.

Confidentiality: Interns will likely handle confidential company information and must sign a Non-Disclosure Agreement (NDA).

Intellectual Property: Work product created by the intern during the internship related to our business generally belongs to Durbhasi Gurukulam, as specified in the Internship Agreement.

Termination: The internship may be terminated by either party with notice, or immediately for cause (e.g., misconduct, breach of confidentiality).

No Guarantee of Employment: Successful completion of the internship does not guarantee future employment with Durbhasi Gurukulam.

Refund Policy (N/A): Internships are typically work/learning experiences and may involve a stipend paid *to* the intern, or be unpaid. Fees paid *by* the intern are rare; if any exist (e.g., for specific training materials), a separate refund policy would apply to those fees.

Limitation of Liability

To the fullest extent permitted by law, Durbhasi Gurukulam Private Limited shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits/revenue, data, or goodwill resulting from your use of the website or any Service.

Our total aggregate liability for any claims arising from a specific Service is limited to the amount you paid us for that specific Service in the preceding 12 months, or INR 8,000 (approx USD 100), whichever is greater.

These limitations apply regardless of the legal theory (contract, tort, etc.), even if we were advised of the possibility of such damages. Specific limitations related to individual services may be found in their respective sections or agreements.

Indemnification

You agree to indemnify and hold Durbhasi Gurukulam harmless from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the website/Services, your User Content, or your violation of these Terms or applicable laws.

Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Jodhpur, Rajasthan, India.
